Terms & Conditions

Terms and Conditions of Sale and Rental

By purchasing or renting equipment from Security Detection Solutions (“SDS”), the customer agrees to the following Terms and Conditions.

1. Equipment Sales – All Sales Final

All equipment sales are final upon purchase. Once an order has been accepted, processed, shipped, delivered, or otherwise fulfilled by Security Detection Solutions, the equipment may not be returned, exchanged, or refunded except as expressly agreed to in writing by SDS.

Customers are responsible for confirming that the equipment ordered is appropriate for their intended application before completing the purchase.

2. Manufacturer/Factory Warranty

Equipment sold by Security Detection Solutions may be covered by the original manufacturer’s factory warranty, subject to the manufacturer’s applicable warranty terms, conditions, exclusions, and limitations.

Any equipment failure, defect, repair, replacement, parts, labor, or other issue that qualifies for warranty coverage will be handled according to the applicable manufacturer’s warranty policies and procedures.

Security Detection Solutions does not extend or modify a manufacturer’s warranty unless expressly stated in writing. Warranty coverage is determined by the equipment manufacturer and is limited to those problems and components covered under the manufacturer’s applicable warranty.

Damage resulting from misuse, abuse, accidents, improper installation or operation, unauthorized modifications or repairs, environmental conditions, normal wear and tear, or other conditions excluded by the manufacturer’s warranty may not be covered.

3. Rental Reservations and Payments

All equipment rental agreements are non-refundable once the rental contract has been signed, except where otherwise expressly agreed to in writing by Security Detection Solutions.

This includes cancellations resulting from changes in event schedules, attendance, weather, venue decisions, staffing issues, or other circumstances outside the control of SDS.

The customer remains responsible for all rental charges and other amounts specified in the rental agreement.

4. Rental Equipment

Rental equipment remains the property of Security Detection Solutions at all times. The customer agrees to use the equipment properly and only for its intended purpose.

Unless otherwise specified in the rental agreement, the customer assumes responsibility for the rental equipment upon delivery or acceptance and remains responsible until the equipment has been returned to or recovered by SDS.

The customer may be responsible for costs associated with equipment that is lost, stolen, damaged, misused, altered, or otherwise returned in a condition beyond ordinary wear and tear.

5. Event Safety and Responsibility

Security screening equipment is intended to assist with an organization’s overall security procedures. No metal detector, X-ray system, weapons detection system, or other security screening equipment can guarantee that every weapon, prohibited item, threat, or security incident will be detected or prevented.

The customer, venue, event organizer, and/or security provider remains responsible for establishing and implementing appropriate security procedures, staffing, crowd management, emergency procedures, and safe operation of the event.

To the fullest extent permitted by applicable law, Security Detection Solutions shall not be responsible for injuries, property damage, losses, security incidents, accidents, or other damages occurring during an event or arising from circumstances outside SDS’s control.

Nothing in these Terms and Conditions is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

6. Proper Operation of Equipment

The customer is responsible for ensuring that individuals operating rented or purchased equipment follow all operating instructions, safety requirements, training materials, and manufacturer recommendations.

SDS is not responsible for problems resulting from improper operation, unauthorized modification, misuse, failure to follow instructions, or use of equipment for purposes for which it was not designed.

7. Damage to Rental Equipment

The customer is responsible for protecting rental equipment from damage, theft, vandalism, weather, unauthorized use, and misuse while the equipment is under the customer’s control.

The customer may be charged for the reasonable cost of repairing or replacing rental equipment damaged, destroyed, lost, or stolen during the rental period, except to the extent otherwise provided in the applicable rental agreement.

8. Limitation of Liability

To the fullest extent permitted by applicable law, SDS shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of revenue, loss of profits, business interruption, event cancellation, or loss resulting from the customer’s reliance upon security screening equipment.

Any limitation of liability applicable to a particular transaction may also be specified in the customer’s quotation, sales agreement, rental agreement, or other written contract with SDS.

9. Acceptance of Terms

By signing a quotation, purchase agreement, rental agreement, or other contract; submitting payment; accepting delivery; or otherwise proceeding with an SDS transaction, the customer acknowledges that it has reviewed and agrees to the applicable Terms and Conditions.

Security Detection Solutions reserves the right to modify these Terms and Conditions for future transactions. The version incorporated into or applicable to a particular transaction will govern that transaction.
